Normative Alert – Regulation for the endorsement of the Individual Employment Contract of national workers and foreign workers

“Regulation for the endorsement of the Individual Employment Contract of national workers and foreign workers”

Ministerial Resolution Nº 001/24 of the Ministry of Labour approves the Regulation for the endorsement of Individual Employment Contract of domestic and foreign workers (the “Regulation”), applicable to all labor relationships subject to a written employment contract.

The term for the endorsement of the individual employment contracts of national workers is 60 calendar days, while for the individual employment contracts of foreign workers the term for their endorsement is 30 calendar days, in both cases from the date of commencement of the employment relationship.

Likewise, the Regulation states that the presentation for the corresponding countersignature after the deadline will not be honored, being presumed that the labor relationship emerges from a verbal employment contract of indefinite term.

In the case of non-compliance with the endorsement of foreigners’ contracts, a fine is also applicable.
